Cash for Kids - Fundraising Guidelines

We're really grateful for all the support YOU provide to Cash for Kids - but if you are planning a fund-raising event, please spare a couple of minutes to check it's all above-board...

 

 

 

 

Certain forms of fundraising require a license to undertake the charitable activity. Under the provisions of the House to House Collections Act 1939 no collection for a charitable purpose (defined as Charitable, benevolent or philanthropic) may be made in any locality unless the promoter is licensed by the Licensing Authority for the area concerned. The purpose of the legal requirement to obtain consent is to ensure collectors are properly authorised and that money is collected in a secure way and the total proceeds collected are properly accounted for.

 

Therefore if you intend to collect on behalf of Cash for Kids, correct permission must be granted by the local authority before collections can take place. Applications should be made to the local authority no later than the first day of the month before the collection is due to take place. This requirement applies to all organisations or individuals that collect from a street or a public highway. No fee is payable for these permits.

Street Collection

Street collection permits are issued by the local authority for collections that take place in public areas.

These collections cannot be undertaken unless prior permission has been obtained from the local council concerned. The Council’s power to regulate street collections and issue licenses is contained in the Police, Factories etc. (Miscellaneous Provisions) Act 1916.Control under the legislation relates to proposed collections in streets or public places where the public have a right of access. It does not, however, extend to such places as the inside of private Shopping Arcades and Supermarkets.

Prior permission can be obtained by completing an appropriate form. There is no cost for the issuing of consent but there are rules to be followed in applying. Please contact Cash for Kids on  01387 250999 in advance before participating in any such fundraising activity.

 

 

House to house Collection

All collections made door to door or conducted in public houses (pubs) must have a house to house permit issued by the local authority.

When a collector going door to door makes a collection of goods or money, a house to house collection permit is required. There are regulations which govern this type of collection. House to house collections cannot be undertaken unless prior permission has been obtained from the council and following communication with a Cash for Kids representative. Prior permission can be obtained by completing an appropriate form. Again there is no cost for the issuing of consent but there are rules to be followed in applying.

LOTTERIES

Section 5 of the Lotteries and Amusements Act 1976 authorises the conduct of small lotteries (e.g. a sweepstake or draw etc.) by Societies for raising money for charities, sport, cultural, or similar purposes other than for private gain. The Rules, Conditions and conduct of Society Lotteries are however too detailed to be summarized here; you are therefore advised to contact the charity for advice.

A lottery must be established for charitable purposes, for the purpose of supporting sport, athletics or a cultural activity or for any other non-commercial purpose other than for private gain.

Scotland

In order to ensure that our charities in Scotland are compliant, there is a process that has to be followed to determine if people collecting on our behalf are Professional Fundraisers, Commercial Participators or Benevolent Fundraisers. This is regulated under the new Charities and Benevolent Fundraising (Scotland) Regulations 2009.
